Notes on Death in the Covenant

In Hebrews 9:16 must be seen in context of the Hebrews 9:15. Many of enter into covenants and nothing requires that one of the parties to the covenant must die. So I suggest that Hebrews 9:16 is more properly translated as "For where that Covenant is" not "For where a testament is". It is obviously the covenant of verse 15 and not just any covenant or testament.

15 And for this cause he is the mediator of the new testament, that by means of death, for the redemption of the transgressions that were under the first testament, they which are called might receive the promise of eternal inheritance.

16 For where a testament is, there must also of necessity be the death of the testator.
